PLEASE READ THE FOLLOWING TERMS AND CONDITIONS (OTHERWISE NOTED AS THIS “AGREEMENT”) CAREFULLY BEFORE USING THE SITE AND ENROLLING IN OUR PROGRAMS.

  1. TERMS OF USE
    1. Acceptance – By accessing any part of the Bouncing Bulb Photography Academy website (the “Site”) or enrolling in a program, you (“User,” “Student,” or “You”) acknowledge that you have read, understood, and agree to be bound by these Terms of Use (the “Agreement”).
    2. Eligibility – Participation is limited to individuals who are at least 18 years of age, or who have obtained the written consent of a parent or legal guardian if under 18.
    3. Account Security – If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Promptly notify us of any unauthorized use.
    4. Participant Obligations: Participants agree not to misuse academy resources, disrupt classes, or infringe on the intellectual property of the academy or others.
    5. Prohibited Conduct – Users may not:
      1. Reproduce, modify, distribute, or create derivative works from any content on the Site without explicit written permission.
      2. Use the Site to harass, defame, or threaten any person.
      3. Attempt to hack, bypass security measures, or disrupt the Site’s operation.
    6. Modification of Terms: The academy reserves the right to amend the Terms of Use at any time, with updated terms posted on the website. Continuing to use the services implies acceptance of the revised terms.
    7. Governing Law and Jurisdiction: The agreement shall be governed by and construed in accordance with the laws of India, with the courts in Bengaluru having exclusive jurisdiction.
  2. TRADEMARKS AND COPYRIGHT
    1. Ownership – All logos, brand names, course titles, graphics, photographs, video recordings, written material, and software on the Site are the exclusive property of Bouncing Bulb Photography Academy (“Bouncing Bulb”) and are protected by Indian and international copyright, trademark, and other proprietary laws. Unauthorized reproduction, imitation, or misrepresentation is strictly prohibited.
    2. Limited License – Upon enrollment, Bouncing Bulb grants you a non‑exclusive, non‑transferable, revocable license to view, stream, and download course materials solely for personal, non‑commercial learning purposes.
    3. Copyright: Course material, lesson plans, photographs, videos, and other media developed by the academy are copyrighted works.
    4. Permitted Use: Participants may access educational material only for personal, non-commercial learning purposes. Redistribution, republication, or sale of such materials is strictly disallowed.
    5. Violation Consequences: Any breach of intellectual property rights may result in immediate course termination, legal proceedings, and claims for damages.
    6. Restrictions – You may not:
      1. Use Bouncing Bulb trademarks in any manner that suggests endorsement or affiliation without prior written consent.
      2. Reproduce, distribute, or publicly display any copyrighted material beyond the scope of the limited license.
    7. Infringement Reporting – If you believe any content on the Site infringes your intellectual‑property rights, please notify us in writing at legal@bouncingbulb.com with a detailed description of the claim.
  3. BOOKING, REFUND AND CANCELLATION POLICY
    1. Enrollment Confirmation – When you complete the checkout process, you receive an email confirming your spot (“Booking Confirmation”). This confirmation constitutes a binding agreement to attend the selected program on the agreed dates.
    2. No‑Refund Policy All program fees are non‑refundable except under the circumstances outlined in section (3.C.iii). By paying, you acknowledge that you will not receive a refund for change of mind, scheduling conflicts, or any other reason.
    3. Program Cancellation by Bouncing Bulb
      1. Full Refund – If Bouncing Bulb cancels a program for any reason (e.g., instructor illness, insufficient enrollment), you will receive a 100 % refund of the fees paid.
      2. Rescheduling Option – Alternatively, you may elect to transfer your enrollment to a future session of comparable value.
      3. Force‑Majeure – Neither party shall be liable for failure to perform due to events beyond reasonable control (natural disasters, pandemics, government orders). In a force‑majeure scenario, Bouncing Bulb will either (i) offer a full refund, (ii) reschedule, or (iii) provide a credit, at its discretion.
  4. PERSONAL AND PROPERTY INDEMNITY RELEASE AND WAIVER
    1. Assumption of Risk – Photography workshops involve the use of lighting equipment, climbing ladders, and on‑location shooting. By participating, you acknowledge and accept all inherent risks, including but not limited to handling equipment, participating in field activities, electric shock, falls, and property damage.
    2. Release of Liability – You, your Legal heirs, family members, and assignees hereby release, waive, discharge, and covenant not to sue Bouncing Bulb, its owners, employees, agents, and affiliates (“Released Parties”) for any personal injury, death, loss, or property damage arising out of your participation, whether caused by negligence of the Released Parties or otherwise.
    3. Indemnification – You agree to indemnify and hold harmless the Released Parties from any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising out of your breach of this Agreement or your negligent or willful misconduct.
    4. Insurance – While not required, we strongly recommend participants maintain personal health and liability insurance covering workshop activities.
  5. RIGHTS OF USE AND RELEASE OF MEDIA
    1. Media Capture – Bouncing Bulb may photograph, video, and audio record participants, their work, and the learning environment during training or events for promotional, instructional, and archival purposes.
    2. Grant of Rights – By enrolling, you grant Bouncing Bulb a worldwide, royalty‑free, perpetual, irrevocable license to:
      1. Use, reproduce, modify, distribute, and publicly display any images, video, or audio that include you or your work.
      2. Publish such media on online platforms (including but not limited to, website, social media channels), printed materials, and third‑party platforms.
    3. No Compensation: Participants acknowledge that no financial compensation will be provided for such use.
    4. Model Release – All participants sign a Model Release form (electronic or paper) that incorporates the language above.
  6. EQUIPMENT AND PROPERTY INDEMNITY
    1. Use of Academy Equipment – Bouncing Bulb Photographymay at its discretion, provide lighting kits, cameras, tripods, and other gear for instructional use. You agree to handle all equipment safely with reasonable care and in accordance with the instructions provided.
    2. Damage or Loss – If equipment is lost, stolen, or damaged due to negligence, misuse, wilful misconduct, mishandling or failure to follow instructions, you will be liable for the full replacement cost or repair fees, as determined by Bouncing Bulb.
    3. Liability Waiver for Third‑Party Gear – If you bring personal gear to a session or on-location shoots, you assume full responsibility for its safety. Bouncing Bulb is not liable for loss, theft, or damage to personal equipment.
    4. Safety Measures – Participants are encouraged to use personal protective measures (such as straps and lens caps) while handling cameras and accessories.
    5. Return Policy – All Academy‑provided equipment must be returned in the condition it was received, normal wear and tear excepted, by the end of the session. Failure to return equipment results in invoicing for the item’s fair market value.
  7. CHANGES TO WEBSITE INCLUDING LEGAL TERMS AND CONDITIONS
    Bouncing Bulb reserve the right to alter or delete the material from the Sites at any time and may, at any time and in its sole discretion, revise the terms of this Agreement by updating this posting.
    Users are bound by any such revision and should therefore periodically visit this page to review the current terms of this Agreement.

  1. Can participants share the academy’s training material with friends?
    No. All training materials are protected under copyright law and cannot be distributed, reproduced, or used commercially without express written consent.
  2. Is there any scenario where a participant can cancel and claim a refund?
    No. Refunds are only provided if the academy itself cancels the program.
  3. What if a participant is injured during a field shoot?
    The indemnity clause makes it the participant’s responsibility. The academy is released from liability for injuries, accidents, or other losses occurring during its programs.
  4. Are participants allowed to post behind-the-scenes videos of academy sessions on social media?
    Only with prior written approval from the academy, since such content may infringe on intellectual property rights.
  5. Who owns the photographs taken by participants during a class?
    Participants retain ownership of photographs they capture themselves. However, the academy may request usage rights for promotional purposes if agreed upon at the time of the program.

BY USING THE SITE OR PARTICIPATING IN A PROGRAM, YOU ACCEPT THIS AGREEMENT

RESTRICTIONS ON USE OF MATERIALS
No materials from the Site may be copied, reproduced, republished, uploaded, posted, re-delivered using framing technology, transmitted or distributed in any way without written permission.
No other permission is granted. 

TRADEMARKS/COPYRIGHTS
The content of the Sites, including all text and graphic images, is copyrighted. The trademarks, logos and service marks displayed on the Sites are registered or unregistered trademarks of Bouncing Bulb Photography, its affiliates or others. Nothing contained on the Sites shall be construed as granting, by implication, estoppels or otherwise, any license or right to use any trademark or copyrightable material displayed without the written permission of Bouncing Bulb or such other third party that may own the trademark or copyrightable material. 

BOOKINGS
Bouncing Bulb accepts enrollments in its programs on a first-come, first-served basis.
Full payment must be received to guarantee your space reservation.
We reserve the right to deny any applicant.
To honour our commitment to our clients, we don’t have a minimum number of students to run a workshop and will run every workshop even with only one student booked.
In this case, the workshop automatically becomes a One to One class with half the hours of the original workshop.
As a One to One class, all content can be delivered in less time as the trainer’s attention is individual. 


 

LIABILITY, RIGHT OF USE, RELEASE , REFUNDS & CANCELLATIONS

LIABILITY
In the event a course or workshop is cancelled by Bouncing Bulb, for any reason, the extent of our liability is limited to the return of fees paid to us.
All workshop participants accept full responsibility for personal injury and personal losses during the period of the course or workshop.
Applications and payments are an acknowledgement of the terms and conditions as outlined on this site.

RIGHT OF USE & RELEASE
Students enrolled into our programs hereby grant permission to Bouncing Bulb Photography to use their image, likeness,  and testimonials for the purposes of marketing, publicity, and promotional materials. This includes, but is not limited to, photographs, videos, audio recordings, and written testimonials taken or recorded during the program.
Usage: Bouncing Bulb Photography may use your image, likeness, and testimonials in various media formats, including but not limited to:
Printed materials (brochures, posters, flyers, etc.)
Online media (websites, social media platforms, email campaigns, etc.)
Presentations and promotional videos
Rights: Its understood that your images and testimonials may be edited, copied, exhibited, published, or distributed for the purposes stated above without further notification or compensation.
Duration: This consent is granted for an indefinite period.
Waiver: You waive the right to inspect or approve the finished product, including written copy, wherein your likeness or testimonial appears. You also waive any rights to royalties or other compensation arising from or related to the use of the image or testimonial.
Release from Liability: You hereby release and discharge Bouncing Bulb Photography, its employees, agents, and representatives from any claims, demands, or causes of action that Iyoumay have by reason of this authorization.

SHORT VERSION
By participating in a Bouncing Bulb Photography Academy workshop, you release the academy from any liability for personal injury or damage to your property. You also grant us permission to use images or videos of you for promotional purposes, and to feature the photos you create during the course (with full credit given to you) to showcase student work.


REFUNDS & CANCELLATIONS

  1. All participants will be refunded in FULL if BBP cancels a workshop.
  2. No refund of fees will be made if you book your Workshop or Course and you decide to withdraw.
  3. No refund of fees will be made for workshops or courses that have been rescheduled.
  4. No refund of fees will be made for unattended workshops or courses after 60 days from the original confirmation date.
  5. No refund of fees will be made for no-shows, or withdrawal after the Course or Workshop starts.
  6. No refund of fees will be made after completion of any Course or Workshop.
  7. No refund of fees will be made for discounted workshops.
  8. Gift Vouchers are not refundable and must be used within 12 months of their issue date.
  9. Deposits and advance payments made for booking a course are not refundable.

BOOKINGS

  7. Bouncing Bulb reserves the right to terminate enrolment in the event of any violation of the stipulated terms and conditions.

 

COURSE FEES POLICY

  1. Enrolment is deemed complete only upon receipt of the prescribed fees at the time of registration.
  2. If you have opted to book a seat by paying an advance, you are required to pay the remainder of the full applicable course fee at least 15 days before the commencement of the course.
  3. In case you have opted to pay the fees using the instalment option –
    1. The instalments will be payable on or before the due date as intimated during the enrolment process.
    2. The instalments have to be paid promptly on or before the due date.
    3. If you have to discontinue temporarily and wish to resume later, the instalments will have to be paid as per the schedule to avoid termination of the enrolment.
  4. In case of a default in the payment, a late payment fee will be levied to the extent of Rs.100/- per day of delay. If the payment is delayed in excess of 10 days from the due date, the classes will be suspended till the arrears are paid in full, along with the late fees.

GENERAL REFUND POLICY OVERVIEW

  • Bouncing Bulb Photography maintains a strict no-refund policy on all fees and booking advances. Participants are encouraged to carefully consider their availability and commitments before enrolling in any course or workshop.
  • Fees and booking advances are non-refundable under any circumstances.
  • Deposits and advance payments made toward course bookings are also non-refundable.
  • There is no refund for courses, workshops, or sessions that are unattended, rescheduled, or delayed from the scheduled start date.
  • Gift vouchers cannot be refunded and must be used within six months from the date of issue.
  • Our team is committed to delivering best-in-class photography training. However, operational and administrative requirements necessitate a consistent refund policy across all programs.

ALTERNATIVE OPTIONS FOR PARTICIPANTS UNABLE TO ATTEND

  • While refunds are not available, Bouncing Bulb Photography does recognize that exceptional personal circumstances may arise. Therefore, under certain conditions, alternatives are provided:
  • 1. Rejoining After Discontinuation
  • If a participant is unable to complete or join the course due to extreme personal hardship, they may resume their course within 90 days of discontinuation.
  • This is subject to:
  • A written request explaining the situation, and
  • Approval from the institute.
  • 2. Postponed Participation
  • If a participant cannot join the course after enrollment, they may reschedule into a future batch (within 90 days), subject to:
    • Availability of seats in the desired batch.
    • Payment of administrative and convenience fees.
    • Adjustment of current applicable fees. Even if the full course fee was paid earlier, any difference between the old and new fee structure will need to be settled.
  • These provisions ensure that while fees are non-refundable, participants still retain flexibility in their learning journey.

REFUNDS IN CASE OF COURSE CANCELLATION

  • If Bouncing Bulb Photography cancels a course outright (not simply delays it), participants will have two clear options:
    • Transfer to another course or batch, or
    • Receive a full refund of the fees paid.
  • Please note: This clause does not apply to courses that are only delayed from the scheduled start date.

IMPORTANT NON-REFUNDABLE SCENARIOS

For absolute clarity, refunds will not be provided in the following cases:

  • Withdrawal by the participant for any reason after booking.
  • Rescheduled or delayed courses or workshops.
  • Unattended courses/workshops after 60 days from original confirmation date.
  • No-shows or withdrawal after the course or workshop begins.
  • After the completion of any course/workshop.
  • Discounted workshops are strictly non-refundable.
  • Violations of terms and conditions leading to termination.
  • Gift vouchers not used within the specified six-month validity.
  • This ensures the policy is applied consistently and fairly across all participants.

PROCESSING OF APPROVED REFUNDS

In the rare cases where a refund is permitted (such as course cancellation by Bouncing Bulb Photography), the following applies:

  • Refunds will be processed within two months after submission and approval of the request.
  • Refunds will be made directly to the registered participant’s bank account.
  • No cash refunds will be issued under any circumstances.

    • If it’s a serious hardship, you may request to join another batch within 90 days. The request must be in writing and subject to approval.
  • What if the course I enrolled in gets delayed?
    • No refunds are issued for delays. You will still have your seat confirmed for the rescheduled start date.
  • What if Bouncing Bulb Photography cancels the course?
